Most people do not know if it is legal to own a TASER in their state. For 88% of America, TASER devices are legal to own.
Only five states currently hold bans on conducted electrical weapons (CEW), including Hawaii, New York, New Jersey, Massachusetts and Rhode Island. Washington D.C. is another major area that currently bans ownership of TASERs and other less-lethal self-defense tools.
Of the states where TASER devices are legal, Illinois has the most-stringent restrictions – requiring a background check, Firearm Owners Identification (FOID) card, and a concealed carry license.
Aside from Illinois, background checks are also mandated in Minnesota and Maryland. Connecticut only allows CEWs to be used for home defense.
From the remaining legal states, three require permits for concealed carry (New Mexico, Delaware and West Virginia), and four require permits for ownership (North Dakota, Wisconsin, Mississippi, and Michigan).
Michigan, a recent victory, concluded that the outright outlaw of a protected arm was ultimately unconstitutional. Arguments backing the ban of TASER devices, including claims that the weapons could be used for torture, were deemed minor and unreasonable by the court judges.
So if you weren’t sure if you are able to obtain a TASER device in your home state, odds are you can! But, if you live in a state where they are still banned, there are a wealth of options to get involved and help lift these bans. Starting an online petition – like on Change.org for instance – with other like-minded individuals is a great start. This can help to start a conversation about the legality of controlled electronic weapons, and the reduction of overall harm they provide.
