Wand: There is not much NAC can do as punishment

In May Wanderlei Silva ran from a Performance Enhancing Drug test administered by the Nevada Athletic Commission. The NSAC has no alternative but – at the least – to regard refusal as a failed test. Silva will in all likelihood be suspended for a year.

Silva had been preparing for a fight with Chael Sonnen at UFC 175. During a formal hearing, Silva said he had been using a banned diuretic, to help with a wrist injury. In a previous statement released via video, he had cited a language barrier as the cause of his dashing out a side door.

Last week the Nevada attorney general’s office filed a formal complaint against Wand, asking the commission to hold Silva responsible for evading a random drug test and his admitted use of a prohibited drug.

In a recent interview with Brazil’s MSN Esportes, Silva said that in a sort of a loophole, the applicable laws do not really apply much in his case.

“I’m already preparing my defense,” said Silva as translated by Guilherme Cruz for MMAFighting. “But there’s not much that can be done (as punishment), there’s no legislation over me. I don’t have a license and I’m not committed to fight in any event at the moment. I will do my defense and, as soon as I have (a fight) coming up, I will do the test and prove that I’m clean to get my license.”

“I want to fight in December, at the end of the year. They always do big events at the end of the year, and this fight could happen anywhere. I will be ready. I would like to fight in Brazil, but we can fight in Japan or even in the United States. But if it really is against Dan Henderson, I would like it to be in a soccer stadium in Brazil.”

Silva will likely soon discover what can be done as punishment by the NAC.
