Nevada court denies motion to dismiss UFC class action suit

In December Jon Fitch, Cung Le, and Nate Quarry were named as plaintiffs in a class-action suit against the UFC, alleging that the promotion held a monopoly position in the sport. Further suits were filed with different plaintiffs, but all were filed in Northern California, where juries and judges are more sympathetic toward class action suits than, say, Nevada.

In January, ZUFFA filed for a change of venue from Northern District of California in San Jose to Nevada, which was granted. The UFC then filed a motion to dismiss the suit.

This was not granted. BE had a play by play of the proceedings.

UFC published an official comment after the discovery ruling:

“The United States District Court in Las Vegas, Nevada held a hearing on UFC’s motion to dismiss today. The Court correctly explained that on a motion to dismiss it must consider all the factual allegations in the complaint as true, and the complaint must be liberally construed in favor of the plaintiffs. Using that standard, the Court denied the motion to dismiss. As we have consistently stated, UFC competes in a lawful manner that benefits athletes around the world and has created a premier organization in the sport of mixed martial arts (MMA). We look forward to proving that the allegations in the complaint are meritless.”
