Lawsuit against Diaz dismissed in Texas

Last June fighters Nate Diaz and Leslie Smith and attorney Sam Awad were sued for alleged breach of contract along with other claims. The lawsuit, in a nutshell, claims that Diaz retained the Ballengee Group, a self-described outfit that represents Mixed Martial Arts Fighters, Professional Golfers, and Professional Baseball Players, among other groups, and offers a wide array of services for their clients to work as Diaz’s agent, that they indeed did work as his agent, and ultimately were not paid for their services.

The group sought more than $1 million from Diaz.

However, TMZ reports that a Texas judge has dismissed the case.

Ballengee claims Nate unexpectedly fired them before the fight (after the deal was done) — and Nate never paid them their cut.

But, according to court docs obtained by TMZ Sports, the judge threw out the case against Diaz — claiming the agents really had no reason to file in Texas … it’s not the right jurisdiction.

“The Court ruled the case should have not have been filed in Texas because Nate has not fought in Texas and dismissed the case,” said Nate’s attorney Jeremiah Reynolds.

It’s technically a victory for Diaz — but Ballengee can still take the case and file it in another jurisdiction … if Ballengee is up for a rematch.

If the Ballengee Group has any aspirations whatsoever in the MMA space, it would behoove them to drop the suit, and move on.
