Judge to rule on Wand ban by May 11

Nevada’s Eighth Judicial District Court Judge Kerry Earley has given herelf untol May 11 to rule on Wanderlei Silva’s current ban in mixed martial arts.

Legendary fighter Wanderlei Silva is under indefinitely suspension by the Nevada State Athletic Commission for running, literally, out the side door, after an attempt was made to test him out of competition. He then no showing a disciplinary hearing on Sept. 23, 2014 to answer dodging the test.

NSAC commissioner Pat Lundvall called it the most flagrant violation we’ve ever seen.

However, Silva has taken the NSAC to court arguing that because he was unlicensed at the time, the state government agency had no right to test him out of competition. MMAJunkie‘s John Morgan reports that both sides argued in court for two hours on Wednesday in Nevada’s Eighth Judicial District Court.

Silva, who did not appear in court, was represented by attorney Ross Goodman. The NSAC was represented by Deputy Attorney General Chris Eccles. Eccles countered Silva’s argument by saying although the fighter was unlicensed, he participated in a news conference promoting the event the day before the test, and thus was representing himself as an unarmed combatant contracted to appear in Nevada.

Judge Kerry Earley expressed the desire to issue a ruling as soon as possible, and gave herself a deadline of May 11.
